Driver Agreement

This Driver Agreement ("Agreement") is entered into between you ("Driver") and Monta ("Company," "we," "our," or "us") regarding your participation as a driver on our ride-sharing platform.

1. Acceptance of Agreement

By downloading the Monta Driver app and creating an account, you acknowledge that you have read, understood, and agree to be bound by this Agreement, our Terms of Service, and Privacy Policy.

2. Driver Eligibility

To be eligible to drive with Monta, you must:

• Be at least 21 years old
• Have a valid driver's license for at least 2 years
• Have a clean driving record
• Pass a background check
• Have valid auto insurance
• Own or have access to a qualifying vehicle
• Be legally authorized to work in your jurisdiction

3. Vehicle Requirements

Your vehicle must meet the following requirements:

• Be a 4-door sedan or larger vehicle
• Be in good mechanical condition
• Have working air conditioning and heating
• Be clean and well-maintained
• Have valid registration and inspection
• Be no older than 15 years (unless approved)
• Have adequate seating and trunk space

4. Driver Responsibilities

As a driver, you agree to:

• Provide safe, professional transportation services
• Maintain a clean, well-maintained vehicle
• Follow all traffic laws and regulations
• Treat all riders with respect and courtesy
• Maintain appropriate insurance coverage
• Keep your driver's license and registration current
• Report any accidents or incidents immediately
• Maintain accurate vehicle and personal information

5. Prohibited Activities

You agree not to:

• Discriminate against riders based on race, religion, gender, or other protected characteristics
• Refuse service without valid reason
• Engage in any illegal activities
• Use drugs or alcohol while driving
• Harass or abuse riders
• Share rider information with third parties
• Use the platform for purposes other than ride-sharing
• Subcontract or allow others to use your account

6. Compensation and Payments

6.1 Fare Structure

Fares are calculated based on distance, time, and demand. You will receive a percentage of the total fare as determined by our current rate structure.

6.2 Payment Schedule

Payments are processed weekly and deposited to your designated bank account. You are responsible for all taxes on your earnings.

6.3 Service Fees

We may deduct service fees, processing fees, and other applicable charges from your earnings as outlined in our current fee structure.

7. Insurance and Liability

You are responsible for maintaining appropriate auto insurance coverage that meets or exceeds the minimum requirements in your jurisdiction. Our insurance may provide additional coverage during active rides, but you remain primarily responsible for your vehicle and driving.

8. Background Checks and Monitoring

We may conduct periodic background checks and monitor your driving record. You agree to cooperate with these checks and provide updated information as requested.

9. Safety and Security

You agree to:

• Follow all safety protocols and guidelines
• Report safety concerns immediately
• Use the in-app safety features
• Maintain a safe driving environment
• Cooperate with law enforcement when necessary

10. Equipment and Technology

You are responsible for:

• Providing and maintaining a compatible smartphone
• Keeping the Monta Driver app updated
• Ensuring reliable internet connectivity
• Maintaining GPS functionality

11. Independent Contractor Status

You are an independent contractor, not an employee of Monta. You are responsible for:

• Your own taxes and tax reporting
• Your own business expenses
• Your own work schedule and availability
• Your own business decisions

12. Termination

This Agreement may be terminated by either party with written notice. We may immediately suspend or terminate your account for violations of this Agreement or for safety concerns.

13. Confidentiality

You agree to maintain the confidentiality of rider information and company proprietary information. You may not share or use this information for purposes other than providing ride services.

14. Dispute Resolution

Any disputes arising from this Agreement will be resolved through binding arbitration, except for claims that may be brought in small claims court.

15. Modifications

We may modify this Agreement at any time. Continued use of the platform after modifications constitutes acceptance of the updated terms.
